Ignition interlock devices are breath-testing machines that attach to a vehicle’s steering column and prevent the car from starting unless the driver provides a breath sample that is within preset limits. A Florida attorney who concentrates on DUI / DWI defense can determine whether an ignition interlock device is likely to be ordered in a particular case.

Even on a first-time Florida DUI / DWI offense, a judge can order the installation of an ignition interlock device.  The device is more likely to be ordered in first-offense drunk driving cases where the motorist refused to take a chemical test to determine blood alcohol content (BAC).

Anyone whose driver’s license is suspended because of a Florida DUI / DWI offense will be required to have an ignition interlock device installed in order to obtain a restricted license in order to drive to work.

Drivers convicted of a first-time Florida DUI / DWI offense who had a child in the car or a BAC of .20 percent or greater will be required to use an ignition interlock device for six months upon reinstatement of the driver’s license. A motorist convicted of a second offense involving those sentencing enhancements will be required to use an ignition interlock device for at least two years.

Motorists convicted of a second Florida drinking and driving offense will be required to use an ignition interlock device for at least one year after the driver’s license is reinstated. Drivers convicted of a third DUI / DWI offense must use the device for at least two years.

Ignition interlock technology works under a simple principle – the vehicle will not run if the driver’s breath sample exceeds the BAC limit programmed into the machine. The device is designed to prevent a third party from blowing into the collection tube in order to start the vehicle.

Once the car is moving, the driver must perform “rolling retests” by blowing into the collection tube every 15 minutes to one hour. If the rolling retest is not performed when prompted, the equipment will record a violation. The device also will record any attempts to tamper with it.
